Privacy Policy and Personal Data Protection

In accordance with the provisions of EU Regulation 2016/679 (European General Data Protection Regulation), we provide the necessary information regarding the processing of personal data carried out through this Site.

1. DEFINITION OF TERMS

Restaurant – Limited Liability Company “ФІАБЕСКО”, code according to USREOU 44257814, registered in accordance with the legislation of Ukraine, information about the Restaurant (including location) and other details are publicly available information posted in the Unified State Register of Legal Entities, Individual Entrepreneurs and Public Organizations, the owner of personal data.

Site – website https://alfresco.com.ua/, along with other websites on the Internet, mobile applications used by the Restaurant to provide Restaurant services and links provided by the Restaurant.

Agreement – ​​the Public Offer Agreement, posted on the Site or on one of its components.

Restaurant services – the subject of the agreement between the parties, including goods and/or services provided by the Restaurant.

Personal database – a named set of organized of personal data stored in electronic form and/or in physical records in the form of personal data files.

User – any adult individual who has accepted this Agreement and/or on whose behalf an Order was placed (i.e., the Agreement was accepted).

Personal account – a section of the Site that provides the User with access to special information and materials. The login and password for entering the Personal account are generated automatically and sent to the User’s e-mail address specified by him during registration (or payment for Restaurant services).

Special information and materials – materials that contain information, either directly or indirectly, about Restaurant services.

Acceptance – any of the following actions:
– using the Restaurant Site by registering on the Restaurant Website (creating a login and password) and/or placing an Order for Restaurant services on the Site;;
– using the Restaurant Site by viewing the materials and/or information posted on it;
making a payment for Restaurant services on the terms and manner outlined in the Agreement;
written (including in electronic form via e-mail) notification made by the User about acceptance of the terms of this Agreement;
logging into the Personal Account on the Site and/or use of an account/account in the mobile application to gain access to place an order;
receiving an email with login and password details for the Personal Account.

Personal data – any information or set of information about an identified or identifiable individual.

Processing of personal data – any action or series of actions, performed on personal data, such as collection, registration, accumulation, storage, adaptation, modification, updating, use and distribution (including sharing, selling, or transferring), depersonalization, destruction of personal data, including with the use of automated systems.

Publicly available sources of personal data – directories, address books, registers, lists, catalogues, other systematized collections of open information containing personal data, posted and published with the consent of the subject of personal data.

Publicly Available Sources of Information – Printed media, television, radio broadcasts, web pages on the Internet and/or created using the Internet, social media accounts, Internet portals, public speeches, and other sources that of information to which individuals and legal entities have free, unrestricted access by applicable law and/or to which the individual has given open access.

Confidentiality of personal data – a mandatory requirement for the Site Administration or any other party who has access to personal data to prevent their distribution/disclosure without the consent of the subject of personal data or a valid legal basis.

Cookies – a term used to describe information in the form of text or binary data received from the Site on a web server, which is stored by the client, i.e. the browser, and then sent to the same site if it is visited again.

IP Address – A unique network address assigned to a device in a computer network that uses the IP protocol.

2. BASIC PROVISIONS

2.1. By accepting this Agreement, the User automatically and fully agrees to this Privacy Policy and Personal Data Protection (hereinafter referred to as the Policy), the terms of processing the User’s personal data.

2.2. If the User does not agree with the terms of the Policy, he is obliged to stop using the Site and the Restaurant Services of the Restaurant and immediately leave it.

2.3. The Restaurant is not responsible for the content and accuracy of the information provided by the User. The User is responsible for the authenticity and veracity of the information specified when placing the Order and provided by him when purchasing the Restaurant Services. The provisions of this clause apply to both information about the User and information about a person other than the User, if the User placed an order on his behalf. Any actions taken to register the User and/or taken using the User’s account/account and/or personal account are considered to be taken by this User.

2.4. The Restaurant is not responsible for third-party sites to which the User may access via links that may be available on the Site.

2.5. By accepting the Agreement, the User confirms that he has reached the appropriate age, which allows him to independently conclude contracts and allows him to independently consent to the processing of personal data.

2.6. In the event that the Restaurant has doubts regarding the User’s reaching the appropriate age, the Restaurant has the right to suspend the provision of Restaurant Services until the circumstances are established and/or refuse to provide Restaurant Services to the User.

2.7. By accepting the Agreement, the User voluntarily consents to the collection and processing of personal data for the following purposes:
1) identification of the User for placing an order and (or) joining the public offer agreement remotely;
2) to obtain information about the Order, process information about the Order;
3) determination of the cost of Restaurant Services;
4) determination of the amount of Payment;
5) purchase of Restaurant Services under the Agreement;
6) providing the User with access to the resources and information of the Site;
7) providing the User with access to his Personal Account/Account;
8) communicating with the User on issues of Restaurant Services, processing his requests;
9) sending by means of communication (e-mail, mobile communication, via the Internet) advertising and special offers, information about promotions or any other information about the activities of the Site, Restaurant;
10) determining the User’s location to ensure security, prevent fraud;
11) developing and improving the quality of Restaurant Services.

The User’s personal data may be used for other commercial purposes of the Restaurant, not provided for by the Privacy Policy, which are within the scope of the Restaurant’s activities.

2.8. The Site Administration is obliged not to disclose and ensure the confidentiality of the User’s personal data provided by the User at the request of the Administration and/or when filling out the form.

2.9. Personal data is provided by the User by providing information, answers on the Site, as well as when using the Site and may include the following information:
1) Full name of the User;
2) User’s age;
3) User’s gender;
4) User’s contact phone number;
5) User’s photos;
6) User’s e-mail address (e-mail);
7) User’s logins on the Internet (including in accounts, messengers, etc.);
8) other confidential data about the User’s identity.

In addition to the above data, the Site Administration reserves the right to automatically collect the following data during the User’s browsing of the Site in order to determine ways to develop the Site and areas for improving the implementation of Restaurant Services:
1) IP address of the User’s electronic computing device (computer, phone, tablet, etc.);
2) information about Cookies stored in the User’s browser;
3) information about the User’s electronic computing devices (computer, phone, tablet, etc.);
4) information about the User’s browser, including the name, browser version, etc.;
5) time of access to the Site;
6) addresses of the Site pages viewed by the User;
7) addresses of previous pages from which access to the Site was obtained.

Disabling the Cookie collection function by the User may result in the inability to access parts of the Site. The Restaurant is not responsible for the inability to use the Site in the event of disabling the Cookie collection function.

2.10. The User’s personal or confidential information specified above shall be stored and not distributed, except at the request of competent authorities and/or only in cases and in accordance with the procedure established by law.

2.11. In the event of loss or disclosure of Personal Information, the Site Administration and the Restaurant shall not be responsible if this information:
1) became or was public at the time of loss or disclosure;
2) became or was posted in Publicly Available Information Sources;
3) was received from a third party before its receipt by the Site Administration;
4) was disclosed with the User’s consent;
5) was disclosed by the User;
6) was disclosed by another person regarding the User.

2.12. The User undertakes not to disclose/distribute confidential information of the Restaurant and other Users, which was received by the User in the process of placing an Order, paying for Restaurant Services, registering, using the Site, Personal Account (including the opportunities provided to him through the use of the Personal Account), Account/Account, using Restaurant Services. All information regarding Restaurant Services, Special Materials, the Site, information, materials, consultations and resources posted on the Site and/or received by the User while using Restaurant Services and other data that became known to the User (including, but not exclusively, while using the chat) is considered confidential. The User has no right to transfer confidential information to third parties

2.12.1. If the User placed an Order and made a payment for himself or herself and for another person, he or she undertakes to transfer the login and password generated for him or her to this person, to comply with the confidentiality conditions of this data and not to disclose them (including the password and login of such a person, to inform such a person of all changes that may affect him or her), and also independently bears responsibility in case of failure to comply with these obligations).

2.13. If the User fails to comply with the requirements specified in clause 2.12, if this has caused the disclosure of confidential information, the User shall be liable in accordance with the procedure established by law and shall compensate the Restaurant (or the owner of such confidential information, if the owner is a person other than the Restaurant) for the losses incurred in full.

2.14. The processing of the User’s personal data is carried out without a time limit, by any lawful means, including in personal data information systems with the use of automation tools or without the use of such tools.

2.15. By accepting the Agreement, the User automatically agrees that the Site Administration has the right to transfer personal data to third parties in order to fulfil the User’s Order placed on the Site.

2.16. The Site Administration takes the necessary organizational and technical measures to protect the User’s personal data from disclosure. The Site Administration will use the User’s personal data exclusively for the purpose (purposes) provided for in this Policy.

2.17. The User guarantees that the indication of personal data of a person other than him in the event of the User placing an Order and/or registering and/or paying for Restaurant Services is carried out exclusively after obtaining the consent of such a person other than the User.

2.18. The User’s rights regarding his personal data are defined in the Law of Ukraine “On Protection of Personal Data”.

2.19. The Privacy Policy comes into force from the moment of its posting on the Site.

2.20. The Site Administration has the right to independently change and/or supplement the terms of this Policy. Such changes and supplements come into force from the moment of their display on the Site.

2.21. This Policy is governed by the norms of the current legislation of Ukraine.
